1.These terms govern all bookings made (whether through Fairs Worldwide’s web site or otherwise) with fwwtravel.com (Australia) ABN 57506 943 948 whose registered office is at PO BOX 11, Kingsford NSW 2032, Australia. All correspondence should be addressed to the above address. You accept these booking terms on behalf of all members of your party.
2.Any booking made or order placed by you shall be deemed to be an offer by you to purchase the relevant travel arrangements subject to these booking conditions. No contract between you and Fairs Worldwide shall come into existence until Fairs Worldwide issues a) booking reference number; b) issues a booking confirmation by email, fax or post; and c) receives payment in full and the reservation is finalised as per the payment conditions.
3.Payment in full is required within 7 days of confirmation of the booking during trade show time or a special event with a deposit paid/balance on confirmation within 7 days.
For periods outside the trade show or special event times different final payment policies exist depending on the hotel payment policies. The booking is still to be guaranteed with a deposit or a credit card if the option of credit card is available. Depending on deposit policies on some of the hotels the deposit may be forfeited as cancellation fee on the booking.
Failure in making payment within the deadline provided on the invoice, during trade fairs or special events, will result in automatic cancellation of the booking.
Fairs Worldwide is entitled to cancel reservations, held for its clients, after fixing a final date if the agreed payment is not made in time or in its full amount. It is imperative that we receive copy of the payment for deposit (and or full payment) by due date and balance is paid into our bank account by due date. In any case should the deposit be paid and balance payment is late, the rooms can be released by the accommodation provider (canceled), leaving us with funds of balance payment only. In this case we will provide alternative rooms with additional payment as we will not be able to recover deposit.
We will not refund unless we can get refund back from the accommodation provider.
In case of full payment being late for the specified order of rooms, we reserve the right to release/cancel the rooms if payment is not received by due date. We will be obliged to provide best possible alternative at the time the payment was made. During major international fairs it may be difficult to provide the same location accommodation as during trade fairs accommodation is scarce and hotels are completely full and require immediate commitment. Any hotel booked as alternative during major trade fairs, must be booked and finalized without delay as the rooms will not be available the following day. The entire cities are booked out including the surrounding areas up to 50 km. There millions of visitors going to international trade fairs and cities can not cope with the amount of visitors staying at the same time. We will source out the best we can.
We will provide alternative accommodation of the same standard, may be further from the original location. We may include transport to/from the Fair.
We will not refund unless we can get refund back from the accommodation provider.

In case that client refuses to pay additional charges for currency flactuations over 10% we reserve the right to cancel and release the booked rooms. Our usual cancellation fees are applicable.
4.Liability: Without affecting any of your statutory rights that cannot be lawfully excluded, we will not be liable for any losses, damages, liability, claims or expenses (whatsoever and irrespective of whether direct, indirect, consequential) arising from the use of or connected with our site or any products or services purchased on our site. We make no warranty or representation as to the fitness or suitability of any product or service displayed on our site. We sell accommodation from inventory supplied by each accommodation provider and we do not over-sell that inventory (we cannot accept liability for unavailability of rooms caused by an accommodation provider over-selling its own inventory).
Where Fairs Worldwide are unable to confirm the initial requested hotel accommodation an alternative may be provided.
Prices are shown in the currency specified with rates exchange calculated on daily basis. Prices may therefore differ on daily basis to reflect any movement in exchange rate levels. When a booking is made the exchange rate will be fixed at the time the booking is created and will apply to any amendments or cancellations to items within the booking. Exchange rates are determined by Fairs Worldwide. In case of currency flactuations between payment received and the date of stay, of more than 10% we reserve the right to ask for extra payments on the rooms.
In case that client refuses to pay additional charges for currency flactuations over 10% we reserve the right to cancel and release the booked rooms. Our usual cancellation fees are applicable.
Star ratings are used to symbolise the overall quality, level of service, food standard and range of facilities available in any given property. The criteria applied in each country will vary depending on the specific requirements established by the relevant issuing body but the outlines below will give a general understanding of what typically can be expected within each category: (THESE RATINGS ARE FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT A GUARANTEE OR WARRANTY OF ANY KIND BY FAIRS WORLDWIDE).
* (1 star) – Majority will be small independently owned properties. There is likely to be a limited range of meals and facilities.
** (2 star) – Varying from small to medium sized properties offering more extensive facilities. Reception and staff will aim for a more professional presentation than at one star level and a wider range of services including food and drink, is likely to be found. Some rooms may be provided with en-suite facilities but this is not guaranteed.
*** (3 star) – Hotel properties will usually be of a size to support higher staffing levels and with a greater quality and range of facilities. Reception and public areas will be more spacious. All bedrooms should come with en-suite facilities and room service may be available.
**** (4 star) – At this level there should be a noticeable difference in the degree of quality in the furnishings, décor and equipment. Bedrooms are usually more spacious than those found in lower star properties. Services such as porterage, 24 hour room service, laundry and dry cleaning may be available.
***** (5 star) – These properties should provide spacious and luxurious accommodation throughout the hotel. Flawless attention to the guest’s requirements should be provided.
Twin room
Contains 2 single beds in same room. Suitable for 2 people.
Double room
Contains 1 double bed. Suitable for 2 people.
Single room
Contains 1 single bed. Suitable for 1 person.
Triple room
Contains twin or double bed/s + extra bed, or two double beds. Most hotels do not have one full size bed for each guest in their triple room.
Quad room
Contains 2 double beds or 4 beds in room suitable for 4 adults.
Twin/Double + Child
Extra bed is provided for a child aged 2-18 years. (Child age may vary depending on a hotel)
NB. Hotels in USA, Australia and Asia will normally utilise existing bedding.
Cot/cradle or crib
Suitable for a child under the age of 2 years
You are expected to make the payment for extras (such as incidental charges, meals, mini bar, dry cleaning and laundry) prior to your departure from the hotel. Hotels in California may levy a daily supplement due to increase in power charges.
The rooms that we include the photos for may not look exactly the same. Every effort will be made to provide you with the same rooms.
6.Fairs Worldwide does not endorse or recommend any particular hotel or travel product. Reasonable care has been taken that the content of this web site is correct but it is subject to amendment at any time without notice. All content on this web site is published in good faith but you acknowledge that Fairs Worldwide as booking agent cannot check the accuracy of all information provided by its suppliers.
7.You warrant that you are at least 18 years of age. All bookings are personal to you and may not be sold, assigned or otherwise transferred. You must be 21 years of age to check into Las Vegas hotels.
8.Our statement and site terms are incorporated into these terms. From time to time we record telephone calls as security measure and to improve and monitor customer service.
9.Passport, visa and health requirements for you and your party are your responsibility. You are strongly recommended to obtain travel insurance against cancellation and for medical cover.
10.Cancellations and amendments to confirmed bookings are subject to the following conditions:
For hotel accommodation:
I) During Special Events/Major Conference periods –
•Customers will be notified before and at the time of booking that the following special conditions will apply*
•100% cancellation charges will apply to dates of stay falling within a Fair or exhibition period or within 2 days before and after the Fair
Any changes or modifications for dates of stay falling within the Fair or exhibition period and /or 2 days before and after Fair, will be treated as cancellations and will incur charges as above unless otherwise agreed.
II (During non-Fair/exhibitions periods –
Cancellation charges will be applied in relation to the notice period between notification of cancellation and the date of stay at EACH hotel within a booking cancellation policy
Amendments and charges where either the number of rooms (irrespective of room type) OR the number of nights decreases will be charged as below:
Cancellations:

72 hours – 1 week The lesser of a) AUD 100 or b) the charge for the first night’s accommodation
1 week – 3 months The lesser of a) AUD 50 or b) the charge for the first night’s accommodation
More than 3 months No charge
Amendments
0 – 72 hours The lesser of a) AUD 50 of b) the charge for the first nights’ accommodation
More than 72 hours The lesser of a) AUD 25 or b) the charge for the first night’s accommodation
Passenger name changes or child age changes will incur no charges. All amendments are subject to availability.
If you do not arrive at the accommodation on the date on which you booked to arrive or you leave the accommodation earlier than the date on which you booked to leave, then you will only be entitled to cancel or amend the booking from the time when Fairs Worldwide receives notification from you during Fairs Worldwide working hours. All such cancellations and amendments are subject to you incurring the charge for the next 24 hours accommodation after Fairs Worldwide’s receipt of notification.
Cancellations notified directly to the hotel will not be effective. Requests for cancellations and amendments must be made on the Fairs Worldwide website.
In case of alternative accommodation offered:
* if the alternative meets the criteria or being sufficiently acceptable during trade fair time, the cancellation fees will apply to any bookings made as per our Booking Conditions.
11.Any complaint about the booking service must be notified to Fairs Worldwide in writing or by email as soon as possible. Any complaint against travel arrangements must be brought to the attention of the local suppliers management as early as possible during your stay and, if not resolved to your satisfaction, should be notified to Fairs Worldwide in writing.
12.Although Fairs Worldwide takes reasonable care to ensure that published descriptions are correct, it is only a booking agent and does not own or operate hotels or other hotel services. Fairs Worldwide accepts no liability for errors or omissions in the descriptions of hotels or other travel services on the website. Fairs Worldwide reserves the right to change your hotel booking to one of at least comparable standard depending on availablity and to notify you of such change/alternative accommodation as soon as possible. No compensation is payable for such changes.
In extreme circumstances (Force Majeur)Fairs Worldwide may be forced to cancel your booking in which case you will be notified of such change as soon as possible and a full and prompt refund will be made.
In any event Fairs Worldwide’s liability will be limited to a maximum of USD 2000.00 or to the total amount that has been paid.
13.Fairs Worldwide shall not be liable for any failure or delay in performance of its obligations which results directly or indirectly from any cause or circumstance which is beyond its reasonable control. Without limiting the liability of the foregoing, the following shall be regarded as such circumstances: acts of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority (including but not limited to refusal or revocation of any licence or consent), fire, flood, lightning, explosion, fog or bad weather, low or high water levels, interruption or failure of a utility service (including but not limited to electricity, gas, water or telecommunications), renovations undertaken by the hotel, strikes, lockouts or boycotts, embargo. In a case of blockade or change of mooring/docking permit regulated by port authorites an alternative will be provided to a hotel of equal value with coach transfers included if necessary.
14.Fairs Worldwide operates as a booking agency and as such its liability to you is limited to a maximum of USD 2000.00 or the total of the amount paid for accommodation. To the extent permitted in law, all conditions, warranties or obligations whether express or implied by statute, common law or otherwise are excluded and these terms shall apply in their place. In case of Hotelship bookings a valid travel insurance premium must be obtained before boarding/checking in on a Hotelship. The shipping company/ship owner has limited liability insurance - please see booking Information/Conditions on our website or hotelship booking conditions below.
15.Fairs Worldwide reserves the right to change these terms from time to time.
16.Your booking is governed by NSW (New South Wales), Australia law and is subject to the exclusive jurisdiction of the NSW (New South Wales), Australian courts. The booking confirmation and these terms represent the entire agreement between Fairs Worldwide and you. You confirm that you have not entered into the contract with Fairs Worldwide on the basis of any representation not expressly incorporated into these documents.
17.Except as otherwise provided in these booking terms and conditions, your statutory rights are not affected.
18.Disputes arising out of, or in connection with, this contract which cannot be amicably settled may be referred to arbitration.
HOTELSHIP BOOKINGS
FAIRS WORLDWIDE
TRADE FAIR/SPECIAL EVENT TERMS AND CONDITIONS
1. EFFECTIVENESS OF CONTRACT
The contract becomes valid and effective once a reservation has been confirmed by Fairs Worldwide to the client either verbally or in writing. On the issue of confirmation/invoice an option is given to pay in full for accommodation (usually 7 days after the confirmation). The reservation is only held by the option date
2. CANCELLATION/PAYMENT/DEFAULT OF PAYMENT
In the event that the client cancels confirmed and paid for services (rooms or Hotelship cabins)-100% cancellation fees apply and no refund will be given.
Specific prices and payment terms are fixed in the confirmation.
It is our recommendation for our clients to take out a travel insurance policy to cover cancellation charges.

3. FORCE MAJEUR
If a reservation can not be honoured due to Force Majeur, such as war, strikes, catastrophe etc. or the threat thereof, and in the case of Hotelship reservations in the event of fuel failure or closure of the waterways, Fairs Worldwide as well as the client are entitled to withdraw from the contract without costs where the client shall not be entitled to any claim. In case of hotelship cabins and in the event of high or low water, we retain the right to change the mooring to the nearest mooring position available, situated within reasonable distance to the Trade Fair premises. If there is no such mooring available, Fairs Worldwide as well as the client are entitled to withdraw from the contract without costs where the client shall not be entitled to any claim
4. PLACE OF PERFORMANCE, CHOICE OF FORUM AND JURISDICTION
The location of the accommodation/Hotelship is the place of performance. German/Swiss law should be applicable. The forum in any dispute related to the contract shall be at the contractual location of the hotelship.
5. CONTRARY OF SUPPLEMENTARY AGREEMENTS; INEFFECTIVENESS
OF INDIVIDUAL PROVISIONS
Contrary or supplementary agreements must be made in writing. Should individual terms of this contract including these terms of business be void, this does not affect the validity of the other provisions. The parties will immediately replace void provisions by valid ones which come closest to the original intention of the void provisions.
6. DENIAL OF PERMITS
If a reservation can not be honoured due to denial of an official permit, in particular mooring permit, where Fairs Worldwide is not responsible for such a denial in any respect, Fairs Worldwide has the right to change the mooring to the nearest mooring position available, provided such mooring position is a reasonable distance from the Trade Fair premises and/or transfer you to a hotel of equal value with coach transfers included if necessary. In the event that there is no such mooring available, Fairs Worldwide will provide accommodation of the same standard or higher within the vicinity of the original location or closest and most conveniently located, where the client shall not be entitled to any claim.
For security and nautical reasons, the ship captain is authorized to change the docking of the ship if required. Any necessary changes will be agreed upon by the captain, the Shipping Company and the charterer. In case of such a change the passengers are not entitled to a price reduction.
If embarkation or disembarkation cannot take place at the agreed location, the Shipping Company shall bear the costs of transporting passengers to the new place of embarkation or disembarkation. Changing the place of embarkation or disembarkation does not entitle a party to cancel the agreement
7. SCOPE OF BOOKING CONDITIONS
Contrary or Supplementary agreements must be made in writing. Should individual terms of this contract including these terms of business be void, this does not affect the validity for the provisions. The parties will immediately replace the void provisions by valid ones which come closest to the original intention of the void provisions.
Only these booking conditions are part of the contract, the clients likely terms of business are rejected
8. Deduction of VAT
Accommodation in Switzerland and Germany is subject to VAT. However, current regulations direct that Fairs Worldwide issues its invoices on a net basis. Should current regulations change and VAT be applicable, Fairs Worldwide shall advise its clients and will be entitled to charge according to any direction issued by the Finanzamt
9. Insurance
The Shipping Company has a permanent liability insurance. The passenger shall be responsible for baggage, theft, accident and travel insurance
10. No show - in case of now shows overnight the hotel/Fairs Worldwide reserves the right to cancel the confirmed reservations
For all B&B properties - directions on how to reach the hotel, telephone/fax numbers will be sent on your accommodation voucher, after full payment is received.
